License

USING THE SOFTWARE INDICATES YOUR ACCEPTANCE OF THESE LICENSE TERMS. IF YOU DO NOT ACCEPT THESE LICENSE TERMS, YOU MAY RETURN THE SOFTWARE FOR A FULL REFUND. 

The following License Terms govern your use of the accompanying SMART REPORT BUILDER unless you have a separate signed agreement with TechNet Solutions, LLC. 

License Grant

TechNet Solutions, LLC grants you a license to use one copy of the SMART REPORT BUILDER. "Use" means storing, loading, installing, executing or displaying the Software. You may not modify the SMART REPORT BUILDER or disable any licensing or control features of the SMART REPORT BUILDER. 

Derivative Works

The software is sold for the purpose of using it within a web based environment to help design and deploy web based reports to end users.

If you are using Free Trial edition, certain functions will be disabled.

If you are using the Standard edition, you may install one instance of the Smart Report Builder. For all editions, you are not permitted under any circumstances to create components or controls, which encapsulate the supplied SMART REPORT BUILDER. You are not permitted to distribute Smart Report Builder as part of a different application. Smart Report Builder is to be used on a single to multiple hosts as per purchase agreement.

The SMART REPORT BUILDER is owned and copyrighted by TechNet Solutions, LLC. Your license confers no title to, or ownership in the SMART REPORT BUILDER and is not a sale of any rights in the SMART REPORT BUILDER. TechNet Solutions, LLC's third party suppliers may protect their rights in the event of any violation of these License Terms.

Copies and Adaptations

You may only make copies or adaptations of the SMART REPORT BUILDER for archival purposes or when copying or adaptation is an essential step in the authorized Use of the SMART REPORT BUILDER. You must reproduce all copyright notices in the original SMART REPORT BUILDER on all copies or adaptations. You may not copy the SMART REPORT BUILDER onto any public network.

No Disassembly or Decryption

You may not disassemble or decompile the SMART REPORT BUILDER.

Transfer

Your license will automatically terminate upon any transfer of the SMART REPORT BUILDER. Upon transfer, you must deliver the SMART REPORT BUILDER, including any copies and related documentation, to the transferee. The transferee must accept these License Terms as a condition to the transfer.

Termination

TechNet Solutions, LLC may terminate your license upon notice for failure to comply with any of these License Terms. Upon termination, you must immediately destroy the SMART REPORT BUILDER, together with all copies, adaptations and merged portions in any form.

Limited warranty

This software is provided as is and TechNet Solutions, LLC disclaims all warranties relating to this software, whether expressed or implied, including but not limited to any implied warranties of merchantability and fitness for a particular purpose.

Limitation on consequential damages

TechNet Solutions, LLC will not be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use such software even if TechNet Solutions, LLC has been advised of the possibility of such damages or claims. In no event shall TechNet Solutions, LLC be liable for any damages exceed the price paid for the license to use the Smart Report Builder, regardless of the form of the claim. The person using the Smart Report Builder bears all risks as to the quality and performance of the Smart Report Builder. Any liability of the seller will be limited solely to product replacement or pro-rata refund of purchase price if any.

Jurisdiction

Any legal action arising from a violation of this license agreement will be arbitrated or tried in the State of ConnecticutUSA, regardless of where this violation might occur.
